1. Who we are
These Terms & Conditions ("Terms") are between you (the customer) and The Tyre Soldier Ltd ("The Tyre Soldier", "we", "us", "our"), a company registered in Scotland under company number SC780607, with registered office at Coast Business Centre, 11 Ainslie Street, West Pitkerro Industrial Estate, Dundee, DD5 3RR.
These Terms apply whenever you book mobile tyre-fitting or a related service from us, whether by phone, WhatsApp, or our website. By booking with us, you agree to these Terms.
2. Our services
We provide mobile, on-site tyre fitting and related services, including:
- Mobile / roadside tyre fitting
- Puncture repair
- Wheel balancing
- Valve replacement and old-tyre disposal
- Emergency callouts
We currently operate across Tayside, Perthshire, and north Fife. We do not currently cover Edinburgh, Stirling, or Aberdeen. If you're outside our working area, we'll tell you when you ask for a quote, before anything is booked.
3. Getting a quote and booking
We give quotes by phone, WhatsApp, or via our website, based on the vehicle registration, tyre size, and postcode you give us. This gets you an accurate starting price, but it's a quote, not a fixed contract price: if, when we arrive, your vehicle's actual condition is different from what was described or from what our systems show — for example a different tyre size actually fitted, additional damage, seized wheel nuts, or a locking wheel nut needing a specific key — we'll tell you before doing any extra work and confirm the final price with you first. You are never charged for work you have not agreed to.
A booking is confirmed once we've agreed a price and a time slot with you. Our separate Booking & Cancellation Policy explains in more detail how rescheduling, cancellation, and "fitter en route" cut-offs work — these Terms and that policy should be read together.
4. Pricing and payment
Our pricing is all-in and transparent. Where a tyre is being supplied, the price we quote includes the tyre, fitting, balancing, valve replacement, disposal of your old tyre, the call-out, and VAT where it applies. There are no hidden extras beyond what's agreed with you before work starts.
You pay when the job's done — never before, and never online in advance of the visit. Payment is due on completion of the work, by whatever payment method is offered to you at the time.
Payment Assist (optional finance). We offer an optional way to spread the cost of tyres or a callout over interest-free monthly instalments through our finance partner, Payment Assist. This is a separate credit product provided by Payment Assist, not by The Tyre Soldier Ltd. It is subject to its own terms, eligibility criteria, and status/affordability checks (0% APR, subject to status). Choosing to use it does not remove or reduce any of your rights under these Terms. 5. Cancellations
If you need to change or cancel a scheduled (non-emergency) booking, please give us as much notice as you can — the sooner you tell us, the easier it is for us to refill the slot. Full detail on notice periods, call-out fees once a fitter is on the road, and what happens if we can't reach you is set out in our Booking & Cancellation Policy.
Your statutory right to cancel. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers who buy at a distance (for example by phone, WhatsApp, or online) normally have a 14-day right to cancel without giving a reason. Because our service is on-demand — you ask us to attend and carry out the work, often the same day — that 14-day right does not apply once we have fully performed the service at your express request. When you book an on-demand or emergency visit, you are asking us to begin work and acknowledging that, once the service has been fully carried out, you lose the right to cancel it under those Regulations. This is normal and lawful for a same-day, on-demand service like ours, and does not affect any of your other statutory rights (see Section 7 below).
6. Insurance and liability
The Tyre Soldier Ltd holds Public & Products Liability insurance with cover of up to £5,000,000. A summary of our current cover is available on request — just ask.
Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any other liability which cannot be excluded or limited under UK law.
Subject to the above, and to the extent permitted by law, we are not liable for indirect or consequential losses (for example, loss of earnings, or loss of use of your vehicle beyond what is reasonable) arising from our services, except where such loss was a reasonably foreseeable result of us breaking these Terms or acting negligently.
7. Your rights if goods or workmanship are faulty
Nothing in these Terms removes or reduces your statutory rights under the Consumer Rights Act 2015. In summary, you are entitled to expect that:
- any goods we supply (for example, tyres) are of satisfactory quality, fit for purpose, and as described; and
- any service we carry out is performed with reasonable care and skill, within a reasonable time, and for a reasonable price where one was not agreed in advance.
If you think a tyre we've supplied is faulty, or that fitting work has not been done properly, tell us as soon as you notice — we will investigate and put things right in line with your legal rights.
8. If your vehicle is damaged during a visit
We take care to avoid damaging your vehicle while we work on it, but if you believe damage has occurred:
- tell us as soon as possible — ideally before the fitter leaves, or immediately after if you notice it later;
- give us the chance to look at what happened and discuss it with you; and
- we will investigate what has been reported and, where appropriate, refer the matter to our public liability insurer.
The Tyre Soldier Ltd holds Public & Products Liability insurance (currently up to £5,000,000). Whether any particular claim is covered depends on the circumstances and our insurer's assessment, and we cannot guarantee in advance that a specific claim will be met. We will always investigate fairly, communicate honestly with you about the outcome, and not leave you without an answer.
9. Data protection
We only use your personal data to provide our services, process payment, and, where you have agreed, to keep you informed about your booking or future offers. Full detail on what we collect, why, and your rights is in our Privacy Policy. If you are unhappy with how we have handled your personal data specifically, use our separate Data Protection Complaint process, where we commit to acknowledging your complaint within 30 days.
10. Complaints
If anything about your quote, booking, or the work carried out isn't right, tell us — most things get sorted quickly by talking to Matt or Keri directly on WhatsApp or by phone. If you'd rather put it in writing, email info@thetyresoldier.co.uk or write to us at Coast Business Centre, 11 Ainslie Street, West Pitkerro Industrial Estate, Dundee, DD5 3RR, for the attention of the directors. We aim to acknowledge every complaint promptly and resolve it as quickly as we reasonably can; complaints that also involve how we've handled your personal data follow the 30-day acknowledgement commitment in our Data Protection Complaint process above.
11. Governing law
These Terms, and any dispute or claim arising out of or in connection with them or with our services, are governed by the law of Scotland, and the Scottish courts have exclusive jurisdiction.
